Eligibility through a spouse

 

British Nationality is not acquired by virtue of marriage to a British Citizen unless you are a woman born overseas and married to a British citizen before 1 January 1949.

  • If the marriage took place between 1 January 1949 and 1 January 1983 you would be eligible for a British passport if you are registered as a British citizen before 1 January 1988.
  • If you are not registered as a British citizen before 1 January 1988 you would not be eligible for a British passport but you may be eligible for a Certificate of Entitlement to the Right of Abode.
  • If you were married after 1 January 1983, you are not eligible for a passport and should visit for Visa section of the website. 
  • If you are planning to go to the UK to live and work and your wife/husband holds a British passport then you may be eligible for an Accompanying Spouse Visa.
